Meeting Minutes
December 7, 2015

6:30 PM:        Open business portion of meeting.
Quorum present: Earl Moffatt (EM), Chair; Peter Skorput (PS); Curt Wilton (CW). Also present: Admin Asst Mark Webber (AA). Press present: Local Yokel.

Board reviews and approves previous meeting minutes.
Board reviews and approves weekly warrants.

7:00 PM:        EM opens the regular meeting to act on agenda items.
  • AA reports that the new police cruiser, as approved at this year's annual town meeting, will arrive sometime in February. It is noted that the Chief of Police has been frustrated over the delay and lack of communication from the vendor – MHQ. That displeasure has been softened somewhat by the lower than expected final cost of the vehicle, approximately $3,500 less than was appropriated.
  • Board, in their capacity as Local Licensing Authority, reviews and acts on annual liquor license renewals. Unanimous approvals, conditional upon verification that all taxes and fees with the Town are current, were granted to the following: Truc's Orient Express; Public Market; Queensboro Package; Rouge; Williamsville Inn; Six Depot and; Shaker Mill Tavern.
  • Board, in their capacity as Local Licensing Authority, reviews and acts on Class II Auto (used car dealer), Class III Auto (junk car license) and Taxi license. Unanimous approvals were granted to the following, conditional upon verification that all Town taxes and fees are current: William Kie, Class II, Class III and Taxi; Troy's Garage, Class II, Class III; Baldwin Motors, Class II, Class III and; Rt 41 Auto LLC, Class II, Class III.
  • AA informs the Board that Gov. Baker will be attending a meeting at Gt Barrington Town Hall on December 22 at 1:30 and requests that a representative from each of the 19 communities who signed on to a Community Compact agreement to study regionalization of the multiple Southern Berkshire School Districts. CW will represent the Town at the meeting.
  • Board grants approvals for 2Village School Use Permits.
  • Board grants conditional approval for a sign permit submitted by a new business to be located at 4 Albany Road, provided that the applicant gain approval from the State regarding distance from the roadway, which is under MA DOT jurisdiction.
  • Wired West meeting with W.S. Finance Committee scheduled for 12-11 has been postponed until a clearer picture of the relationship between Wired West and the Mass Broadband Institute (MBI) is presented. MBI, the primary State funding and control agency for broadband initiatives to bring high speed service to rural areas recently went public with concerns over Wired West's long term viability. MBI will present their concerns at a public forum at Berkshire South Community Center on December 17 from 2-4.
  • AA informs the Board that a building permit application was submitted to the Building Inspector by a member of the Village Association. It is noted that the Board, at its previous meeting, requested that the Association seek an opinion from the Building Inspector on their proposal to adapt the public restrooms for use as an information booth, not to seek a building permit. Board further notes that no one other than the Board is authorized to file a building permit application for Town owned property.
  • Board discusses a complaint filed by David Potter, 24 Pixley Hill Road regarding the condition of his neighbor's driveway at 27 Pixley Hill Road, which Mr Potter asserts is causing water runoff to enter his property causing damage. Both EM and CW note that they have inspected the site within the last week. CW states that the Town will be doing scheduled general grading and maintenance in the area of concern as it does each year. CW further states that both driveways were installed prior to the adoption of zoning bylaws regulating the construction of private driveways (2001). #27 installed in 1994 and # 24 in 1995, according to Highway Dept records. Accordingly, Mr Potter's request that the Town pursue violation action against the owner of # 27 cannot be taken since both driveways pre-date the regulations he cites. CW adds that both driveways would be non-conforming under current bylaws. No formal action will be taken other than to recommend to the owner of #27 to clean up and re-grade the bottom portion of this driveway, which may provide relief to his neighbor across the street.
  • AA informs the Board that the Department of Revenue, as of 12/7, approved the Town's annual tax rate for Fiscal Year 2016 at $12.33
8:10 PM:        There being no additional business to come before the Board, CW makes a motion to
adjourn the meeting. EM seconds the motion. Vote taken, 3-0 in favor.

Board reviews and approves previous warrants.

Other Business/Action/Discussion Items:
  • Carol Kuller, representing the Cable TV Commission reports to the Board that she and fellow Commissioners have been in continuing contact with Wired West representatives Steve Sautman and Jackie DelRossi along with FinCom Chair Bob Salerno in order to keep up to date regarding events regarding with Wired West, MBI and Charter TV. Carol asked that the Board keep her group up to date with any developments, particularly with Charter. Board thanked Carol and Steve for all their efforts to date and pledged to continue an open exchange of information going forward.
  • Board has a general discussion regarding the driveway complaints on Pixley Hill Road. CW reports that he, along with the AA visited the site. EM notes that he visited the site on another occasion. CW reports that both the driveway at issue and the driveway of the person who expressed concerns pre-exist the adoption of zoning bylaws regulating driveways and that both would be non-compliant under current regulations but are not subject to current standards. Accordingly, the Town has no authority to order either party to maintain their driveways. CW adds that the Highway Department historically grades Pixley Hill Road, along with the other gravel roads, twice a year.
  • CW will attend a session at the Great Barrington Town Hall tomorrow to participate in a Commonwealth Community Compact signing pledging sharing of goods and services among 11 South Berkshire communities.
  • The Berkshire Hills School Committee will be holding a regular meeting at the West Stockbridge Town Offices on January 14th.
